Gwinnett County Residents against Rezoning Case CIC2009-00022
This petition has been created by the Edgewater Home Owners Association (Lawrenceville, GA) Board in order to voice our collective concern and objection to the potential rezoning of a property located on Old Peachtree Road between the Edgewater and Peachtree Parc subdivisons. The zoning request as being considered under case CIC2009-00022 would permit the developer to build homes with a minimum of 1400 sq ft versus the currently required 2400 sq ft. The following provides a background to the current case being considered by the Gwinnet County Planning Commission Board. ♦ The Property was sold to a developer in late 2006 and this developer asked for a zoning change from R-100 to T-TH (townhomes) ♦ The Original rezoning case was heard in Feb. 2007 for this piece of property located between Edgewater and Peachtree Parc Subdivisions. It used to be a privately owned piece of property with a single house on it. ♦ Planning Board and Planning Commission both recommended DENIAL of this change as it was not consistent with the 2020 land use plan and did not fit in with surrounding properties (ie. Edgewater). ♦ Kevin Kenerly, who is the board representative for our district, recommended approval of a zoning change from R-100 to R-TZ (one step above townhomes) with certain conditions, one of which was that the minimum sq. footage of homes had to be 2400 sq. ft. ♦ Board approved this zoning change and developer immediately cleared this land in the spring of 2007 and installed the roads, sewer, and retention pond. ♦ The Housing crisis hit at the same time and this property has sat vacant for over two years as I am sure most people have seen as they drive past on Old Peachtree. ♦ The Developer is apparently taking a financial beating on this property and wants the conditions changed to allow for much smaller homes to be built. Developer feels this is the only way to market the property at this time. Developer wants the minimum sq. footage reduced from 2400 to 1400 sq. ft. (the size of most basements in edgewater) We really need to stand united on this and show a unified voice that we do not want apartment sized homes next to our subdivision. Some may think that it is not a big deal and will not affect them if they do not live directly in view of this property. However, a subdivision of 1400 sq. ft. homes will have a negative impact on the marketability of all of our homes, as this can be used for comparative pricing is this area. The following was provided by our Real Estate Committee Chair: Further development of minimal square footage dwellings that are adjacent or in close proximity to our subdivision is and will continue to diminish our price per square footage when a valuation (appraisal) of our properties are done. These new dwellings are prone to sit vacant and unsold for extended periods of time due to recent real estate conditions. This will lower our values even further because these properties will have to be sold at a lower price point. Some of our home values are already down by $100,000 over the past 2 years. The values of our Edgewater homes cannot be supported with the significant amount of new construction of these minimal square footage dwellings. Our properties will continue to decline and we need to stop this NOW!
